Ly DP – In this analysis, the investigator determined whether injury reports against one’s practice peer may be related to a greater subsequent use of diagnostic imaging. The investigator conducted analyses using 2009-2011 claims data for a random 20% sample of Medicare beneficiaries linked by physicians to publicly available 2010-2012 injury reports on Florida physicians from the Florida Office of Insurance Regulation. Overall, 361 physicians with peers who had an injury report across 2,918 physician quarters were included. For physicians whose peers had an injury report, the mean rate of advanced imaging was estimated to be 2.3 per 100 evaluation and management (E & M) visits. In the first quarter after an injury report against a physician’s peer, advanced imaging rates rose 0.78 per 100 E & M visits vs a mean of 2.3; however, this rise did not persist. In line with a previous investigation, a possible impact of perceived malpractice risk, rather than objective malpractice risk, on defensive medicine was supported by the findings of this study.
